Compliance with Export Laws

Customers are responsible for ensuring that the import, use, resale, or transfer of Atlas products complies with all applicable laws and regulations in their country or region.

Import Requirements

The customer is solely responsible for:

Any delays or additional costs arising from customs clearance or local regulations remain the responsibility of the customer unless otherwise agreed in writing.

Delivery Terms

Unless otherwise agreed in writing, all international shipments shall be governed by the applicable Incoterms® specified in the sales contract or commercial invoice.

The agreed Incoterm defines the transfer of risk, transportation responsibilities, insurance obligations, and cost allocation between Atlas and the customer.

Customers should carefully review the agreed delivery terms before placing an order.

Product Suitability

Atlas provides technical information and product recommendations based on the information supplied by the customer.

The customer is responsible for verifying that the selected product is suitable for the intended application and complies with all local regulations, safety standards, and installation requirements.

Customs Delays

Atlas shall not be liable for delays caused by:

  • Customs inspections
  • Border clearance procedures
  • Government regulations
  • Import restrictions
  • Documentation reviews
  • Transportation disruptions
  • Force majeure events

Estimated delivery dates are provided in good faith and should not be interpreted as guaranteed delivery commitments.

Documentation

Where applicable, Atlas may provide export documentation such as:

  • Commercial Invoice
  • Packing List
  • Certificate of Origin (upon request, where available)
  • Product Technical Datasheets
  • Product Catalogues
  • Other documents agreed upon before shipment

The availability of specific documents may depend on the destination country and applicable regulations.

Limitation of Liability

Atlas shall not be responsible for:

  • Import restrictions imposed by destination countries.
  • Customs duties, taxes, or brokerage fees.
  • Delays caused by customs authorities or freight carriers.
  • Costs resulting from incorrect shipping information provided by the customer.
  • Losses arising from the customer’s failure to comply with local import regulations.
